Q: What do I do when I receive the shipment from trucking company?

When receiving shipments via truck, it is important to understand and accept the obligations of being a receiver of freight. To make the delivery go smoothly, follow the below guidelines:

Before signing the carrier’s delivery receipt:

  1. Count the number of cartons and verify the number being shipped from the receipt.
  2. Visually inspect the physical condition of the cartons for any rips, tears, punctures, crushed corners, etc. You must notate these discrepancies on the delivery receipt before you sign and accept the shipment. Failure to do so will imply you have received the shipment in good condition, by which you have accepted complete responsibility and liability for the contents.
  3. Due to the pandemic, many freight companies have started implementing what they refer to as “Contactless Delivery”. They will oftentimes reach out to you via email, phone call, or text, but in some instances, we have been informed that they’ve just dropped off the package as other small parcel couriers would. Should your delivery fall into this category, please inspect the part immediately for damage and reach out to the freight company directly, and then to us within the same day. Please also take pictures of the damages to the product and any other damages/flaws to the box. Failure to notify the freight company the same day will waive your right to claim insurance for any issues. When notifying the freight company of damage, please do not hinder your chances by saying anything more to them than the item is damaged. Any additional information you provide of how, why, or anything else regarding the damage may work against you. 
  4. If the cartons are heavily damaged, you have the option of refusing the delivery. Please write “Refused Due to Damage” on the receipt, then sign appropriately.

Please take the time to examine the condition of the cartons before signing and accepting the delivery. The shipper and the carrier cannot be held liable if the proper notations do not appear on the delivery receipt.

Q: Is it legal?

Items sold by VIS Racing Sports Inc. ("VIS") may not be legal for street use in all states and none of the parts from our company are DOT approved. It is the purchaser's responsibility to comply with applicable state laws. All fiberglass or carbon fiber parts have no warranty. All goods are sold as is unless otherwise specified. There are no other warranties, express, implied, including any warranty of merchantability or fitness for a particular purpose.

 

 

Q: What is the cancellation policy?

Our cancellation policy is designed to reflect the commitments and costs associated with the preparation and handling of orders. For all special orders, a nonrefundable deposit of the total costs is required at the time of order placement. If the Buyer decides to cancel the order for any reason, this deposit will be forfeited immediately to Vis Racing Sports Inc.

Once an item has been shipped, the Buyer cannot cancel the order. This policy is in place because once the shipment is en route, both outbound and inbound shipping costs are incurred. Therefore, if a cancellation is requested after the item has been shipped, these costs must be covered, preventing cancellation at this stage.

Vis Racing Sports Inc. is not responsible for any delays in shipment. All provided shipping dates are estimates and should not be considered guarantees. Consequently, the Buyer is not entitled to chargebacks, price reductions, or other offsets due to late shipments or failure to deliver within the estimated time frame.

Furthermore, if special order items remain unclaimed for more than 30 days from the time Vis Racing Sports Inc. receives the parts in stock, and the Buyer has made no attempt to claim their order, the order will be considered canceled. Under these circumstances, all deposits previously made will be forfeited to Vis. For items from our regular stock, you have to send them back to us within 14 days from the date we originally shipped them to you. Most of our products are in stock and will be shipped within 48-72 hours on average, but in some high volume cases, may require up to a full work week. Some out of stock items may take 4-12 weeks to produce and ship, but differ from a SPECIAL ORDER in where the item cannot be cancelled early for any reason, but may be when item is 2 weeks past the ETA (Due to customs issues at times). Items may not be reserved without payment or deposit. In the event that an item is promised without payment, full documentation must be sent and acknowledged.

Q: SHIPPING INSTRUCTIONS

Given the size and nature of our products, the shipping company may call you to schedule an appointment for delivery. Accordingly, please provide us with your current phone number and we will forward that information to the shipping company, if applicable. Also, please make sure that you keep your shipping appointment. If you are not available for your shipping appointment, then the item will be shipped back to the distributor and you will be charged for the round trip shipping.

Q: REPLACEMENTS AND RETURNS

All issues not related to damage, which must be noted to the driver per receiving instructions at the time of delivery, must be noted by the buyer within five (5) days of receipt as long as it is returned in original packaging and the buyer pays for return shipping. Note that shipping fees are non-refundable and a 30% restocking fee will be applied. All return requests must be made within five (5) days after receiving order. RMA’s must be provided prior to any returns and the items must be in an unused and unaltered condition with the original packaging. Refunds will not be issued on returns that are damaged during return shipping or if the product is not received in original packaging or better, which must be pre-approved by VIS Racing, but is not a mandatory approval. In the event that damage does occur, a refund will be issued when a claim has been settled with the shipping company. Failure to comply with this return policy will result in a refusal of the shipment and will be returned to you at your expense.

We reserve the right to modify or override requests regarding replacement or refund. For example, we will not replace or refund a complete body kit if a single component is found to be defective.

Refunds will not be issued due to poor fitment of the body kit. If fitment is off by extreme margins, a refund will be considered at our discretion. Moreover, no replacements or refunds will be provided in the following situations:
• Any product that has been subject to misuse, neglect, accident, or improper installation.
• Any product that does not have proof of professional installation at an auto body shop experienced in aftermarket fiberglass installation.
• Any product that has been modified or altered from its original manufactured state.

Q: SHIPPING OUTSIDE OF THE CONTIGUOUS US

Customers needing delivery outside of the contiguous US (including but not limited to Alaska, Hawaii, US territories, and foreign countries) must first request a quote. Transactions made without first requesting a quote will be refunded and cancelled.

Because customs policies and fees vary from country to country, the customer is responsible for payment of all applicable customs fees and duties. In addition, you may be obligated to hire a customs broker to satisfy the customs requirements. Be sure to check with your local customs office regarding these requirements prior to purchasing.

We are willing to ship orders to a designated freight forwarding company that will handle the delivery of your purchase to your country, territory, etc. If you choose to use a freight forwarding company, you do not need to request a shipping quote from Bestbodykit.com as long as the delivery address is within the contiguous US. Hiring and use of a freight forwarding company is the responsibility of the customer.

THE PARTIES RETAIN THE RIGHT TO APPEAL THE ARBITRATOR'S DECISION AS SET FORTH BELOW. The parties shall equally share the arbitrator's fees. The parties shall have full rights of discovery under the Civil Discovery Act and shall have the right to file dispositive motions (such as a demurrer, motion to strike, or motion for summary judgment) just as if the case were being litigated in court. All motions shall be heard by the arbitrator. If either party refuses to select an arbitrator or submit the dispute to arbitration, either party may petition the Los Angeles Superior Court for an order appointing an arbitrator or compelling arbitration. The arbitrator shall apply California substantive law to the proceeding. The arbitration shall be conducted in Los Angeles, California. An award may be entered against a party who fails to appear at a duly noticed hearing. Q: WAIVER OF TRIAL

IF THE FOREGOING BINDING ARBITRATION CLAUSE WERE NOT IN THIS AGREEMENT, THE PARTIES WOULD EACH HAVE THE RIGHT TO A TRIAL BY JURY OR BY A JUDGE IN THE EVENT OF ANY LITIGATION BETWEEN THE PARTIES. THE PARTIES ARE EACH GIVING UP THE RIGHT TO A JURY TRIAL OR COURT TRIAL IN ANY DISPUTE BETWEEN THE PARTIES BY SIGNING THIS AGREEMENT. YOU SPECIFICALLY UNDERSTAND THAT THE RIGHT TO HAVE SUCH DISPUTES DECIDED BY A JUDGE OR A JURY IS HEREBY WAIVED.

Q: GOVERNING LAW

Any controversy of claim arising out of or relating to the construction or applications of any term, provision, or condition of these Terms shall comply with and be governed in accordance with the laws of the state of California.

Q: JURISDICTION

If any dispute arises out of or in connection with these Terms, except as expressly contemplated by another provision of these Terms, the parties irrevocably: (i) consent and submit to the jurisdiction of courts located in Los Angeles, California; (ii) waive any objection to that choice of forum based on venue or to the effect that the forum is not convenient; and (iii) WAIVE TO THE FULLEST EXTENT PERMITTED BY LAW ANY RIGHT TO TRIAL OR ADJUDICATION BY JURY.

Q: SEVERABILITY

Each provision of these Terms (a "Provision") shall be deemed severable. If any Provision or the application of any Provision to any person or circumstance shall be held invalid or unenforceable by a court of any jurisdiction:
• The Provision shall be ineffective only in that jurisdiction.
• The Provision shall be ineffective only to the extent that it has been expressly held to be invalid or unenforceable in that jurisdiction.
• The ineffectiveness of the Provision shall not invalidate any other provision of the Terms or the application of the Provision itself to persons or circumstances other than those with respect to which it was held invalid or unenforceable in the jurisdiction in question.

Q: NO WAIVER

Nothing contained herein shall be construed as a waiver by VIS Racing of any of our rights or remedies described in these Terms unless the waiver is in writing and signed by an authorized agent of VIS Racing. No delay or omission by us in exercising our rights or remedies will impair or be construed as a waiver. Any single or partial exercise of a right or remedy will not preclude further exercise of any other right or remedy. Our failure to enforce the strict performance of any provision of these Terms will not constitute a waiver of our right to subsequently enforce such provision or any other provisions of these Terms.

Q: FORCE MAJEURE

Neither party will be held responsible for any inability or delay in fulfilling their obligations under this Agreement for the duration in which such inability or delay is caused by events outside of their reasonable control, including but not limited to acts of God, acts of public enemies, wars, strikes, labor disputes, or other unforeseen circumstances. It is agreed that a shortage of financial resources does not constitute a cause beyond a party's control. Each party agrees to immediately inform the other party upon the occurrence of any such event and will endeavor to resume the fulfillment of the affected obligations as soon as possible once the issue has been resolved.

Q: NO THIRD-PARTY BENEFICIARIES

This Agreement is made for the sole benefit of the parties involved and their respective successors and permitted assigns. Nothing herein, express or implied, is intended to or shall confer upon any other person, firm, or entity any legal or equitable right, benefit, or remedy of any nature whatsoever, under or by reason of this Agreement. No person or entity other than the parties to this Agreement shall be entitled to bring any action to enforce any provision of this Agreement, nor shall any person or entity other than the parties be deemed to be a beneficiary of this Agreement or any of its provisions.

  3. Document the Damage: If you notice any damage, it's crucial to document it. Take photos of the damage and ensure that the delivery receipt includes a clear description. Always write "Damaged" on the receipt.

  4. Refusing Damaged Shipments: If the box is severely damaged or compromised, we advise you to refuse the shipment. Clearly state "Damaged" as the reason for refusal on the delivery receipt, and make sure it's noted by the carrier.

  5. Severe Damage: For shipments with significant damage, refuse the delivery outright and document the reason as "Damaged" on the receipt. Take pictures of both the damage and the delivery receipt.

  6. Contactless Delivery: If your delivery is contactless, inspect the package as soon as you receive it. If damage is present, take photos immediately and report the issue to both us and the freight company on the same day. Claims may be denied if damage is not reported on the day of delivery.

Q: Contactless Delivery

As a result of the pandemic, many freight companies have introduced "Contactless Delivery" procedures. While some may notify you via email, phone call, or text, others may simply leave the package without prior communication, similar to small parcel couriers. If your delivery falls under this category and the shipping company doesn't require a signature or appointment for delivery, it's crucial to act swiftly. Notify both the shipping company and Vis Racing on the same day as delivery. Any delay in reporting damages may lead to the shipping company denying the damage claim. We urge you to inspect the item promptly for any damage and document it by taking pictures of both the product and any flaws or damages to the packaging. Failure to notify the freight company on the same day will forfeit your right to claim insurance for any potential issues.

Q: Crate Delivery

  1. Inspect for Damage: Upon delivery, please take a moment to thoroughly inspect the crate for any visible signs of damage, such as dents, punctures, or tears. If you notice any damage, kindly make a note of it on the delivery receipt and clearly write "Damaged".

  4. Severe Case: If your shipment contains severe cases, please exercise extra caution during inspection. In case of any visible damage to the crate housing, it is advisable to refuse the shipment outright and ensure that the damage is noted on the delivery receipt.
  5. Contactless Delivery: Upon receiving your delivery, inspect the package immediately for any signs of damage.  If any damage is observed, please report it to us within the same day of delivery.  Failure to report damages on the same day may result in your claim being declined.
  6. Signature Confirmation: Upon accepting the delivery, kindly provide your signature on the delivery receipt. However, if you choose to refuse the shipment due to damage, please ensure that the refusal is properly noted and signed accordingly.

Q: Driver Refuses For Inspection

If the delivery driver refuses to allow you to inspect the shipment upon delivery, follow these steps:

  2. Step 2: Photograph the Package

    If you choose to accept the shipment despite the refusal, write ‘Damage’ and ‘Driver Refused Inspection’ on the delivery receipt before signing. This documents that you were not allowed to inspect the goods.
